the "Platform.” By accessing, using, or placing orders through the Platform,
you, on behalf of yourself and all members of your household and others who use
any service under your account, agree to the following terms and conditions

Applicability:
Before
accessing, using, or placing an order on the Platform, please carefully review
these terms and conditions. These Terms and Conditions define the contractual
relationship between you and the specified seller of the products and services
listed on the Platform and constitute the entire agreement between the parties
involved. They cover the offerings of products and services, your ordering
process, delivery, warranties provided, and all related services.
Products and
services offered by parties other than Tajer are available through the
Platform. Additionally, we may provide links to the websites of affiliated
companies and select other businesses. When you purchase products or services
provided by these third parties, you are buying directly from them, not from
Tajer, and Tajer only places the order on your behalf and facilitates the
delivery of the ordered items.
By
registering on our Platform, you will be asked to confirm in the checkbox that
you accept these terms and conditions, and thus you will be deemed to have
accepted these terms and conditions prior to using the Platform and/or if you
place your order. If you do not agree with any of these terms and conditions,
you must not use the Platform or place an order from us.
The use of
our Platform is governed by our Website Use Terms, which are accessible on
Platform. Our Privacy Policy also applies and can be found on the Platform.

These Terms
and Conditions apply solely to consumers and individuals who purchase goods or
services for personal, non-professional use. When placing an order, the
consumers/individuals warrant to (a) Use the Services only for lawful and
non-fraudulent purposes, avoiding any actions that cause nuisance or
inconvenience (b) Provide accurate information during registration and update
any changes promptly. (c) Keep your account details secure and private. (d) Use
the products and Services for your personal, non-commercial use, and not resell
the product or any part of the Services. (e) Not engage in any activity that
could impair the functionality of the Platform or the Services. (f) Report any
bugs, unauthorized access methods, or breaches of intellectual property rights
that you encounter. (g) Use any promotional or reward offers responsibly
without exploiting it.
2.
Offering:
The products
or services, and their displayed price, are not considered as binding offers
from our side. Your order is an offer to buy from us, and only our confirmation
of the order by e-mail will constitute a binding contract.
All the
products that are offered within our Platform are available while our stock or
the stock of our suppliers lasts. Not all the displayed products are in stock.
We cannot guarantee that each product is immediately available for purchase.
Only our confirmation notice based upon your order will indicate the
availability and the timing for delivery. If for any reason beyond our
reasonable control, we are unable to supply a certain product, we will not be
held liable and we will ensure that you will not be charged for that product.
In case of
unavailable product, we may offer a substitute product. You will be informed in
advance in that case, and the product will only be supplied if you agree.
We try to
display the images of our products as accurately as possible, however we cannot
guarantee that certain images would give an unclear or distorted image of the
shape or color of the products.
The
depictions and descriptions of our products and services are only valid for a
limited period of time. If you decide later to purchase a product or service,
you should re-examine the description.
In case we
have erroneously displayed the incorrect price of a product, we will not have
an obligation to deliver it to you at the indicated price, provided that we
notify this in our order confirmation or at the latest before the dispatch of
the product. Our order confirmation will not be regarded as binding if the
price was clearly erroneous. You will then have an opportunity to buy the
product at the correctly proposed price. If you would refuse to buy the product

Ordering:
You must

The ordering
process follows different steps through the pages of the virtual shopping Cart.
At every step, you will be able to return to the former step of the process in
order to correct any errors or to modify your requirements.
Before your
final order at checkout, we will present you an overview of the product or
service purchased by you, the complete purchase price including delivery costs,
and the estimated number of days for delivery. For deliveries outside of Qatar,
the prices at checkout do not include additional costs such as applicable
taxes, fees, duties, and customs charges incurred during the shipping and
delivery of the product or service. These additional costs are the
responsibility of the customer and must be paid directly to the shipping and
delivery service provider prior to delivery. Your order and our confirmation
will be stored in our database and these files will serve as a proof of the
transaction.
Your order
is an offer to purchase a product or service from us.
We will send
you an order confirmation by e-mail, including the goods or services purchased,
the all-inclusive price and as the case may be any restrictions or reserves. Only
our order confirmation email will constitute a binding purchase contract.
You are
responsible for the submission of correct information in your order, such as
your billing information, the delivery address, and other useful information in
relation to the delivery.
We reserve
the right to refuse the sale of products or services to any person or any
geographic region for any reason at any time. This can be decided on a case-by-case
basis. Furthermore, we reserve the right to limit the volume of products or
services that we offer for one purchaser, one household or for one order, and
such a decision may be based on orders by the same account, the same credit
card or the same billing or shipping address. We reserve the right to prohibit
or limit sales to dealers or resellers.
We reserve
the right to discontinue any product or service at any time.
You have a
right to modify or cancel your order within three days from the order confirmation
or before it is shipped by us whichever comes first. You will not be entitled
to cancel or modify the order after the occurrence of any of the above. After
delivery, the return, warranty and exchange of sold goods and services is
subject to our Warranty, Exchange and Return Policy, available on our website
and mobile app on iOS and Android.
In case you
have paid for a product that we are unable to supply or that we decline to
supply because of any of the above-mentioned reasons, we will fully refund the
prepaid price as stated in our Warranty, Exchange and Return Policy.
You agree
that the digital logs that we keep with digital files evidence your and our
transactions and messages, which will constitute proof of your and our
transactions.

Customer Requirements and
Representations:
Notwithstanding any other requirements stated
in our terms and conditions, in order to be able to register, use and to
purchase products or services, you must fulfil the general requirements of this
clause:
You represent and warrant that the information
you provide at registration, or at any other time, is correct, accurate, and
complete. We reserve the right to cancel any of your orders, terminate your
rights to use Tajer, and delete your record if deemed necessary, at the sole
discretion of Tajer.
5.
Password and Security:
When you register at the Platform, you will
create an identification code for login and a password. We urge you to use a
password that is sufficiently original and that is not obviously linked to your
person so that it can be guessed by third persons.
Every action and transaction, including any
order, that is done using this login and password will be deemed to have been
done by you, and you will solely be held responsible for such action.
Thus, it is essential that you keep the login
identification and password confidential and that you will not disclose it to
anyone, nor share it with other persons. If you allow certain other persons,
such as family members, to access our Platform using your login identification
and password, you are responsible for such usage and you must ensure that such
persons are aware of the terms and conditions, and that they comply with these
terms and conditions.
If you believe that your password is no longer
confidential nor secure, , you must reset it immediately through our platforms.
If we have reason to believe that there is
likely a breach of security, or misuse of our website, or that your password is
being misused in any way, we may require you to change your password, and we
may suspend your account if the password has not been changed. We will not be
liable for any losses arising out of any unauthorized access to, or use of our
services or purchases through your account.

Price:
All commercial and contractual terms related
to the products and services are solely negotiated and agreed upon between the
user and the seller. These terms include, but are not limited to, pricing,
delivery charges, warranties concerning products and services, and any post-sale
support, if any. Tajer does not control, influence, or participate in the
formulation or acceptance of these commercial and contractual terms between the
user and the seller. However, Tajer may provide support services to sellers in
areas such as order fulfillment, payment methods, payment collection, delivery,
and call center support under separate agreements with each seller. The pricing
of products and services is established by the sellers themselves, with no
involvement or influence from Tajer in setting these prices.
The indicated price of a product that is
displayed on our Platform does not include the delivery charges, costs, fees,
customs, duties, nor the taxes that are eventually due, which will depend on
the place of delivery and the delivery method that you choose. The final price
does not include the applicable charges, costs, fees, customs, duties, and
taxes incurred during the shipping and delivery service outside Qatar and they
are under your responsibility to pay prior to receiving the product or service.
From time to time, Tajer and/or individual
sellers may, at their sole discretion, extend promotional offers featuring
distinct terms and varying rates to certain users. Unless specifically directed
at you, such offers will not affect your existing agreements or offers. The
execution and legitimacy of these promotions are contingent upon the seller's
adherence to the terms, and Tajer assumes no liability for the administration
or fulfillment of these offers.
7.
Payment Methods:
1. Payment will be done in the currency Qatari Riyals (QAR).
2.
We
accept the following payment methods, subject to changes from time to time:

Payment Solutions - the service provider provide various payment methods including
but not limited to credit card, debit
card, G Pay, apple pay.

Wallet Credits.

Cash Payment on Delivery (COD) -
temporarily unavailable.
3.
The
chosen payment method will be indicated by the consumer during the ordering
process at the checkout of the virtual shopping Cart.
4.
Payment
information, such as credit/debit card details, will be sent encrypted using
the SSL technology.
5.
Please
note that the Platform itself does not handle or authorize financial
transactions directly. All payments should be made through designated payment
gateways. Tajer will facilitate the transfer of payments made via the payment
gateway or another authorized system to the seller.
6.
The
terms and conditions or schemes of that payment service provider will apply to
your payments and to your purchase, insofar this is indicated by the payment
service provider. We do not offer more rights, remedies or warranties than
those provided by the payment service provider, and you are advised to read
their terms and conditions carefully. We are not liable for actions or
negligence of payment service providers.
7.
When
making payments, you may be required to submit your sensitive information to
authorized payment gateways. You must provide accurate and correct card details
to these gateways to access the services. The information you provide will only
be used or shared with third parties when necessary for fraud verification or
as required by law, regulation, or a court order. You are solely responsible
for safeguarding the confidentiality and security of your card details. We
explicitly disclaim any liability for unauthorized card use.
8. Delivery:
We normally ship and deliver the purchased
products and services through specialized delivery services providers to the
delivery address that you have specified when you completed the order.
We provide international delivery to over 60
countries. You can find a list of countries to which we deliver on our
Platform. The lead times for the delivery are indicated at the checkout page
and based on your country. These times are approximate only. In case delivery
does not take place within the indicated timeframe, you must contact our customer
service, for further information and we shall notify you for any delay or other
difficulties experienced by it that have substantial effect on the delivery.
We will be liable, and you are entitled to
terminate the contract and obtain a full refund, if delivery does not take
place within 30 calendar days after your order, unless we have agreed on a
longer lead time.
For larger objects, please check the
measurements of the product and the packaging if indicated, and check whether
it will fit in an elevator, door, path or any other space. You will be
responsible for such verifications.
The accuracy of
delivery addresses is the sole responsibility of the customer. We are
entitled to hand over the package to any person available at the destination
address who signs the delivery note and who declares, by signing, being authorized
to take the delivery. We will not be liable if such a person has not been
authorized by you to accept the delivery.
If no person is present or willing to receipt
the delivery after three attempts, the order will be returned to Tajer. The
customer will be responsible for all associated delivery and return fees, as
well as any charges during the process such as duties, taxes, fees, customs,
duties, and other expenses incurred. Should the products be expired or
non-returnable, the customer will also be liable for their cost. Payment for
these charges will be deducted from the customer’s wallet balance. If the
wallet balance is insufficient, the amount will be recorded as a negative
balance. This negative balance must be settled before any future purchases can
be made. Customers with a negative wallet balance for more than 30 days may
have their account suspended, and Tajer reserves the right to undertake the
necessary actions to recover the outstanding amount.
9.
Inspection at Delivery:
You are advised to inspect immediately the
products at the time of delivery, and if that is not possible, at least as soon
as is practicable.
If you would discover a defect or
non-conformity for which you believe that we are accountable, you must notify
us within Seven (7) days, failing which you will be deemed to have accepted the
sold goods.
When you submit ratings and reviews for
purchased items or sellers, these contributions are recognized as User Content
and governed by these Terms and Conditions. Your reviews and ratings must be
based on firsthand experiences and should be truthful, non-discriminatory, and
free from offensive content or fabricated facts. They should not be influenced
by any vested interests in the items sold or the sellers. These submissions
should reflect your personal opinion, for which you hold sole ownership and responsibility,
including any consequences that arise from them. Tajer does not endorse these ratings
and reviews, nor do they reflect the opinions of Tajer or its affiliates.
Furthermore, Tajer is not liable for any ratings and reviews or for any
economic losses, including loss of opportunity, loss or profits, that may
result from them to any party.
10.
Warranty Exchange and Return Policy:
All information, content, materials, products,
and other services provided to you through the Platform are offered by Tajer on
an "as is" and "as available" basis, unless otherwise
specified in writing. Tajer makes no representations or warranties of any kind,
either express or implied, as to the operation of the Tajer services, or the
information, content, materials, products, or other services provided to you,
unless stated otherwise in writing. You expressly agree that your use of the
Platform is at your sole risk.
To the fullest extent permissible by law,
Tajer disclaims all warranties, both express and implied, including but not
limited to, implied warranties of merchantability and fitness for a particular
purpose. Tajer does not warrant that the services, information, content,
materials, products, or other services made available to you are free of
viruses or other harmful components. To the fullest extent permissible by law,
Tajer will not be liable for any damages of any kind arising from the use of
any service, or from any information, content, materials, products, or other
services made available to you through the Platform, including, but not limited
to, direct, indirect, incidental, punitive, and consequential damages, unless
otherwise specified in writing.
If a product or service comes with a warranty, the specific duration and details of the warranty will be included in the offer's description. The actual warranty documents will be provided within the package that contains the product or service. If the product description does not mention a warranty, then the product or service does not come with one. If the description does not specify a warranty, our Warranty, Exchange, and Return Policy will apply.
As part of our
commitment to providing a convenient and secure shopping experience in the
State of Qatar, "Tajer" platform adheres to the warranty, exchange
and return policy in compliance with the laws, regulations, and decisions of
the state of Qatar.
11.
Third Party Service Providers
You acknowledge and
agree that Tajer serves as a platform for hosting products and services offered
by Sellers and specifically does not:
1.
Offer any warranties, either express or implied, about
the quality of products and services provided by Sellers;
2.
Endorse any products or services, nor does it certify
that these meet particular standards or ratings;
3.
Bear liability for any dissatisfaction, loss, damage,
or injury resulting from the utilization of products and services from Sellers;
4.
Assume responsibility for any alterations made to the
products and services by Sellers.
Tajer does not
endorse, review, inspect, verify, evaluate, or guarantee any offerings from
third parties. Furthermore, Tajer disclaims any liability concerning the
quality, safety, or accuracy of these products or services.
You acknowledge and
agree that Tajer ships and deliver products and services through specialized
shipping and delivery providers. Responsibility for delivery is assigned to the
designated delivery party, accountable for any related delays or errors.
It is essential for
you to review the policies, terms, and conditions of third-party sellers
thoroughly before making a purchase.
The User acknowledges
that Tajer is not responsible nor assess the legality or capability of any
Seller or delivery services provider. The User agrees that Tajer will not be
liable if they are unable to utilize an offer from a Seller due to the Seller's
non-compliance with any statutory rule, regulation, or licensing requirement
and holds no responsibility for a third party's adherence to applicable laws or
regulations.
12.
Intellectual Property and copyrights:
All content available through the Platform,
including text, graphics, logos, button icons, images, audio clips, digital
downloads, data compilations, and software, is owned by Tajer or its content
suppliers and is protected by Qatari intellectual property and copyright laws.
You are not permitted to reproduce, duplicate,
copy, capture, sell, resell, or commercially exploit any portion of our goods
or services, without our prior written permission. You are not permitted to
remove any copyright notice or trademark.
Purchased software may include End User
License Agreement or other types of licenses that contain conditions and
limitations of use; you must verify such terms when you install and use the
software.
13.
Indemnity
You agree to indemnify, protect, and hold
Tajer, its affiliates, employees, officers, directors, and partners harmless
from any claims, losses, damages, liabilities, costs, and expenses, including
but not limited to legal fees and expenses, arising from or related to
(a) your use or misuse of the Platform;
(b) any breach by you of these Terms and
Conditions or any other policies governing your use of the Platform; or
(c) any breach of the representations,
warranties, and covenants you have made.
Tajer has the authority, at your expense, to
exclusively handle and direct the defense of any situation necessitating your
indemnification, including the power to resolve such issues. You must support
Tajer in managing and settling these claims. Additionally, Tajer will endeavor
to inform you as quickly as possible of any third-party claims, actions, or
legal proceedings that fall under this indemnity agreement once they become
known. This provision will remain in force beyond the expiration or termination
of these Terms and Conditions.
Subject to applicable law, Tajer's obligation
to indemnify under these Terms and Conditions shall be limited solely to
circumstances where indemnification is mandated by statute. In such cases, the
maximum liability of Tajer for any claims related to any purchase made through
the platform, including but not limited to claims of error or defect in any
goods or services provided, harm, damages, expenses, losses or other, shall not
exceed the amount actually paid by the user for the order in question. Tajer shall
not be liable for any indirect, incidental, consequential, special, or
exemplary damages, even if advised of the possibility of such damages. This
limitation of liability shall survive the termination or expiration of these
Terms and Conditions.
14.
Liability for Products or Services:
To the fullest extent permissible by law, Tajer
will never be liable, or held liable for any special, indirect, incidental,
consequential, punitive, reliance, or exemplary damages arising from (1) the
use of purchased products or services, including but not limited to moral or
commercial damages, loss of opportunities, except where liability is mandated
by Qatari law. (2) this Terms and Conditions and Tajer other policies
applicable to you; (3) the Products, Services, the Platform; or (c) Your use or
inability to use the Platform. In all cases, Tajer liability for any damages will
be limited to the fullest extent permitted by Applicable Law. This paragraph
shall survive the termination of these Terms and Conditions
Any compensation for damages or liabilities caused
solely by products or services sold through the Platform will be limited to
liabilities and obligations explicitly assumed by the Seller and as stipulated
by applicable Qatari law.
In case of liability for products causing
damage, we will not be liable if you can file a claim against the Seller, manufacturer,
importer, distributor, vendor of the product directly, If we would be held
liable notwithstanding our disclaimer we will only be liable up to the maximum
liability assumed by the Seller, manufacturer, distributor, vendor or importer,
and all disclaimers and exclusions expressed by the Seller, manufacturer,
distributor, vendor or importer will apply to us as if these were formulated by
us.
In case our product contains a defect that
creates a danger or risk to the health or safety of consumers, we will respect
the legal framework for product recalls, and we will inform the market about
the risks as the Law requires. If you would have purchased such product, we ask
you to follow the instructions for the return or repair of such product.
We will not be liable for damage caused by an
incorrect use or maintenance of a product, by an infringement on the conditions
for purchase or any instructions, warnings, age restrictions, or modifications
to a product that were not approved by us.
15.
Exceptional Circumstances:
We will not be liable if we cannot fulfil our
obligation, or if the execution would be so burdensome or expensive that we
would risk a major loss, due to an exceptional event (force Majeure) that we
could not reasonably anticipate such as but not limited to wars, civil wars, act
of wars (including missiles, projectiles, explosions, mass weapon usage), invasions,
armed conflicts, terrorist activities, and other state of emergency conditions,
government actions confiscations, sanctions, strike, work stoppages, riot,
crime, act of God, natural disasters (including hurricane, flood, earthquake,
volcanic eruption, epidemics, pandemics, typhoons, tornadoes, volcanic
eruptions, and other acts of nature), government-imposed quarantines, shortages
of raw materials, regulatory or Legal restrictions. In such circumstances we
will assess whether we can fulfil a delayed obligation, when the circumstances
would allow us to perform in a reasonable manner.
16.
Changes to the policies, Terms and
Conditions:
We are entitled to update and modify these
terms and conditions as well as our policies from time to time. The fact that
the policies, terms and conditions have been updated will be notified to you by
e-mail or via an announcement on our Platform.
The new policies, terms and conditions apply
to any purchases after the date of application thereof.
You are encouraged to review the terms and
conditions before every subsequent purchase and by indicating that you have
read the policies, terms and conditions before placing your order, you are
deemed to have accepted these terms and conditions that are currently
applicable.

on our platform.
In case of discussions about the applicable
version of terms and conditions in a particular point in time, the applicable
version that we keep in our database as valid at a particular point in time.
If you do not agree with the modification of
the policies, terms and conditions and if the modification has really a
negative impact on your use of the services, you may terminate the current
contract and in case of prepaid services, you will receive a refund in
proportion with (pro rata) the period of time that you could not use the
services.

telephone number, e-mail address or address indicated by you at the time of
your registration.
We have the right to send you commercial
communications by e-mail if you have given specific consent for such use of
your data. You will be able to withdraw your consent and to opt out of such
communications as is stated in our Privacy Policy.
18.
Complaints:
In case of complaint, we urge you to contact

customercare@tajershops.com or via phone on (+974) 52088820. Customer service is
available from Sunday to Thursday: 8:30 AM – 5:00 PM. We will review your
complaint in good faith and will try to find an acceptable solution if your
complaint seems justified.
19.
Various:
If any clause of these terms and conditions is
deemed unenforceable or will become unenforceable by a court order or due to
new legislation, it will be deemed null and void, the remainder of the Contract
shall continue in full force and effect, and you and us will be deemed to
accept a clause that is valid and is as close as possible to the content of the
unenforceable clause.
You are not entitled to transfer any rights,
any obligation, or any subscription to a third party without our prior written
consent.
Failure by either Party to enforce any
provision of this Agreement at any time shall not be construed as a waiver of
such provision or of the right to enforce such provision.
20.
Applicable Law and Disputes:
Our contractual relationship, and the
validity, interpretation and execution of these Terms and Conditions is
governed by the Law of Qatar and in compliance and not in contradiction with
Islamic Sharia provisions.
The Court of Qatar will have the exclusive
jurisdiction regarding any disputes based on the use of the Platform and our
contractual relationship.
